PI Case Work-up Services

DiCello Paralegal Services also offers, through its association with veteran PI paralegal, Kimala Krchnavi, the following
PI case work-up services:

  1. Organize client files and note any missing records/bills.
  2. Obtain all related medical records and bills.
  3. Obtain lost wage information from employers.
  4. Locate all lien-holders and request final liens.
  5. Review liens and/or Explanation of Benefits statements to determine which medical services have been paid by health insurance companies or auto insurance med pay, how much they paid and if there is an outstanding balance due.
  6. Obtain lien information from Medicare and MediCal.
  7. Total all billed medical costs.
  8. Total all medical bills paid by insurance.
  9. List all medical providers, their addresses, telephone numbers, patient account numbers, dates of service, billed costs for services and paid amounts for services for use in Demand letters, mediation or arbitration briefs or for trial.
  10. Review medical records to make sure none are missing or to note potential problems such as prior injury to the same area or for client prescription drug abuse.
  11. Assist clients in dealing with their health insurance companies to get their bills paid.

PERSONAL INJURY (PI) DEMAND LETTERS

Once your PI case has been thoroughly worked-up, let DiCello Paralegal Services prepare your demand letter package.

I specialize in drafting PI demand letter packages that effectively communicate the severity of your client’s injuries, and the clear extent of the tortfeasor’s liability. The result is a letter and exhibit package that encourages case settlement by unequivocally demonstrating the weaknesses in the insured’s position, should the case go to trial.

In most cases, I can get a settlement demand package out the door fast, and into the hands of an adjuster. Let me help you get that PI case on the road to settlement.

I offer three types of demand letter preparation, all at affordable, flat rates. The descriptions below are guidelines only. If I determine that the actual total of past and future medical bills cannot be accurately ascertained at the time I draft your demand package, you will be billed the maximum amount ($249.00). In addition, if the particular job is determined by me to be complex in nature, I reserve the right to charge the maximum amount ($249.00). California jury verdict and settlement research available at additional cost.

Option One - $169.00 flat fee

  • Past and future medical specials up to $10,000
  • MIST-type injuries (Minimum Impact Soft Tissue)
  • Single ER visit (Level 3; undergoes triage process)
  • No hospital stay
  • One or two primary care physician visits
  • Short course of chiropractic or physical therapy
  • No or minimal wage loss

Option Two - $209.00 flat fee

  • Past and future medical specials between $10,001 and $50,000
  • Moderate injuries
  • Single ER visit (Level 2; moderate injuries; undergoes triage process)
  • Short hospital stay
  • A few primary care physician visits
  • Extended course of chiropractic or physical therapy
  • Moderate wage loss

Option Three - $249.00 flat fee

  • Past and future medical specials over $50,000
  • Major injuries
  • ER visit (Level 1; serious/critical injuries requiring immediate treatment and advanced care)
  • Moderate to prolonged hospital stay
  • Several primary care physician visits
  • Lengthy course of chiropractic or physical therapy
  • Extensive wage loss
  • Client often unable to return to work/may require retraining

What You and Your Client Get for Your Money
All demand letter package options include:

  1. Review of your client’s medical records;
  2. Review of your client’s medical bills;
  3. A review of the accident report or other documentation of the incident;
  4. Legal research re: law applicable to your case;
  5. Drafting of the demand letter.  Letter will include discussion of:
    1. the incident;
    2. injuries and treatment;
    3. economic damages;
    4. the theory of liability that controls the case; and
    5. amount of the demand (as determined by you and your client)
